O R D E R

This petition is filed to withdraw H.M.O.P.No.45 of 2016 pending on the file of Principal Sub Court, Perundurai and transfer the same to the file of Family Court, Coimbatore. 2.The learned counsel for the petitioner submitted that both the petitioner and respondent are living together and still the respondent has not withdrawn H.M.O.P.No.45 of 2016 filed by him. He seeks permission of this Court to withdraw the Transfer Petition with liberty to file a fresh Transfer Petition, if H.M.O.P.No.45 of 2016 is not withdrawn by the respondent and he has also made an endorsement to that effect.

3.Recording the endorsement made by the learned counsel for the petitioner, the Transfer Civil Miscellaneous Petition is dismissed as withdrawn with liberty to the petitioner to file a fresh Transfer Petition, if H.M.O.P.No.45 of 2016 is not withdrawn by the respondent. No costs. Consequently, connected Miscellaneous Petition is closed.
