Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of writ of Mandamus directing the Respondents 1 to 3, being the Housing Board , to take steps to Consider request of transfer of allotment of Flat No.H-103/G-4, HIG, Tamil Nadu housing Board Flats, Thiruvanmiyur Neighbourhood Extension Scheme, Besant Nagar, Chennai-90 in Favour of the petitioner by Considering the representation dated 28.02.2026 fixing a reasonable cost for the same, Considering all the facts and Consequently directing the Respondents 1 to 3 to permit the petitioner to continue to occupy and reside in the Said Flat till such a decision is taken and pass.

Mr.T.K.S.Gandhi Order This Writ Petition has been filed by the petitioner to direct the respondents 1 to 3 to take steps to transfer the allotment of the Flat in question in favour of the petitioner by considering his representation dated 28.02.2026.

2. Case of the petitioner is that the original allottee viz., Dr.S.Rajalakshmi, had entered into a Lease Agreement through her Power Agent with the petitioner and his wife and they are the lawful lessee in possession and enjoyment of Flat No.H-103/G-4, HIG, Thiruvanmiyur neighbourhood Extension Scheme, Besant Nagar Division. While so, the 1st respondent issued an Eviction Notice dated 03.11.2025 in respect of said flat, alleging that the allotment was cancelled in the year 2021 as there are arrears

and called them to vacate from the Flat. The said Rajalakshmi was died few years back and as the petitioner could not find out the whereabouts of the legal heirs of respondents 4 and 5, he was unable to give proper reply to the Housing Board for the said Notice. Thereafter, the notice dated 03.11.2025 was issued by the 1st respondent directing the petitioner to vacate from the Flat. Hence, the petitioner filed W.P.No.45300 of 2025, wherein this Court allowed to possess the property for a period of four months till 31.03.2026. Thereafter, the petitioner in order to acquire the property on his own had sent a letter dated 28.02.2026 to all the respondents and also to the Chief Minister's Cell, to consider the said request. Since no response is forthcoming on the said representation/letter, the petitioner is before this Court.

3. The learned counsel appearing for the petitioner would submit that it would suffice, if the respondents are directed to dispose of the representation of the petitioner dated 28.02.2026 on merits and in accordance with law, within a specified period.

4. The learned counsel appearing for the respondents has no objection for such an order being passed by this Court.

5. Heard the learned counsel appearing for the petitioner and learned counsel appearing for the respondents.

6. In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the respondents to consider the representation/letter of the petitioner dated 28.02.2026 and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
