Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to pass orders on the application dated 19.2.2014 seeking recognition of Two Wheeler and Four Wheeler Mechanic Trade from the academic year 2014-2015. The petitioner would state that the petitioner industrial training school was established in the year 2000 and it was granted temporary recognition initially and renewed periodically and vide proceedings dated 02.07.2009, the first respondent has granted permanent recognition with effect from 01.07.2008 for the following trades:
1. Automobile Mechanic 1+1 2units one year course
2. Electrical Technician 1+1 2 units one year course 2.The petitioner would further state that from the academic year 2014-15 it intends to start two units of additional trade namely, Two Wheeler and Four Wheeler Mechanic and for that purpose, submitted application dated 19.02.2014, with all the relevant particulars and
documents and also paid prescribed fees and it was also received and acknowledged. The second respondent has also nominated Assistant Director to cause inspection and accordingly inspection was conducted on 24.03.2014. The recommendation was also made for grant of recognition from the year 2014-2015 and the petitioner has received a communication dated 11.03.2014 calling upon them to produce building structural stability certificate and no objection certificate from fire safety and rescue services department and those documents were also submitted.
The petitioner anticipating recognition for additional trades and by taking note of the previous orders passed by the first respondent has also admitted 43 students. The second respondent has also called for list of candidates for approval to be submitted on or before 30.09.2014 and it was also sent. The examination schedule was also notified and inspite of it, the respondent did not choose to pass any orders and therefore, the petitioner came forward to file this writ petition. 3.Heard the submissions of the learned counsel appearing for the petitioner and Mrs.P.Rajalakshmi, learned Government Advocate appearing for the respondents.
4.This Court without going into the merits of the claim projected by the petitioner in this writ petition and taking into consideration the limited scope of prayer sought for by the petitioner, directs the respondents to consider the application/ representation dated 19.02.2014 submitted by the petitioner seeking recognition of Two Wheeler and Four Wheeler Mechanic trades from the year 2014-2015 in accordance with law and pass orders within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
