Writ petition filed under Article 226 of the Constitution of India to issue a Writ of mandamus directing the Respondent to pay the retirement benefits such as the benefits of Earned Leave the benefit of old Medical Leave and other retirement benefits payable to the petitioner with interest at the rate of 12% from the date of retirement. For Appellant : Mr.T.N.Rajagopalan,GP Asst. by Ms.S.Rajeni Ramdas For Respondent : Mr.A.Rajendiran J U D G E M E N T (Judgement of this Court was made by S.MANIKUMAR, J) Challenge in this writ appeal is to an order dated 02.02.2017, made in W.P.No.43667 of 2016.

On instructions from Mr.Sivachandrama, Section Officer (Legal), Transport Department, Mr.T.N.Rajagopalan, learned Government Pleader, submitted that the balance amount of Rs.62.70 crores with interest upto 18.09.2018, has been disbursed to the retired Transport Corporation employees through ECS.

3. Mr.A.Rajendiran, learned counsel appearing for the respondent employee in the instant writ appeal, acknowledges the https://hcservices.ecourts.gov.in/hcservices/

said submission.

4. Journey in a writ petition seeking retirement benefits started in June, 2016. Grievance of the retired employees was pending for a long time. Due to the cooperation of Mr.V.Ajoy Khose and Mr.A.Rajendiran, learned counsel appearing for the retired employees, Mr.Vijay Narayan, learned Advocate General, Mr.T.N.Rajagopalan, learned Government Pleader, Ms.S.Rajeni Ramdas, learned Standing Counsel for Transport Corporation, and in particular, Mr.P.W.C.Davidar, I.A.S., Additional Chief Secretary to the Government, Transport Department, who has taken prompt and positive steps, this Court was able to pass orders periodically, granting relief to the retired employees. At one stage, the retired employees, though awaiting retirement benefits, graciously accepted that a sum of Rs.

720 crores, being the arrears of compensation, be paid first to the accident victims, though the said sum was offered to be paid by the Government towards their retirement benefits. This Bench record their due concern to the victims of accident. We sincerely hope that the grievance of the retired employees is redressed, though belatedly, by the Government.

5. In view of the above, instant writ appeal is closed. The above judgement is passed without prejudice to the rights of the retired employees. Consequently, the connected miscellaneous petition is also closed.
