ORDER
The grievance of the petitioner in this writ petition is that without any notice, the respondents are now attempting to demolish the building of the petitioner located at the address morefully disclosed in the prayer to this writ petition.
2. On the last hearing date, i.e., on 02.04.2026, the learned Special Government Pleader accepted notice on behalf of the respondents and sought time to get instructions.
3. Today, an affidavit has been filed by the 3rd respondent and a copy of the same has also been served on the learned counsel for the petitioner. On instructions, learned Special Government Pleader appearing for the respondents would submit that the respondents would not interfere with the possession and enjoyment of 1150 sq.ft., which is still retained by the petitioner subsequent to the acquisition of the land measuring 162 sq.ft. out of 1312 1⁄2 sq.ft.
4. In view of the undertaking given by the respondents that they shall not interfere with the petitioner's peaceful possession and enjoyment of the property measuring 1150 sq.ft., which is morefully dislosed in the affidavit filed Page No.2 of 4
in support of this writ petition, the prayer sought in this writ petition has been achieved.
5. Accordingly, this Writ Petition is disposed of by declaring that the petitioner is entitled to peacefully enjoy the ownership and possession of the property measuring 1150 sq.ft. as disclosed in the affidavit filed in support of this writ petition as the said land is not the subject matter of any land acquisition by the respondents. It is made clear that only by following the due procedure established under law, the respondents are permitted to acquire the land measuring 1150 sq.ft. retained by the petitioner. No costs. Consequently, the connected miscellaneous petition is closed.
