No 7004/ Uoo. 2/ 2022 dated 01.02.2023 with all consequential and other attendant benefits including payment of arrears of salary to the petitioner.

ORDER

This writ petition has been filed seeking a direction to the respondents to disburse the salary and arrears to the petitioner for the post of Life Guard in the 3rd respondent college from 01.02.2022.

2. The petitioner was appointed as Life Guard on 01.02.2022 in a sanctioned vacancy caused by the retirement of the previous incumbent on 31.01.2022. His appointment was approved by the second respondent on 01.02.2023 with retrospective effect from 01.02.2022, and pay was fixed in Level-1 at Rs.15,700-50000/-. Despite such approval, salary has not been paid. Though the petitioner has submitted representation, no action has been taken. Hence, the present writ petition.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 and 2.

It is brought to the notice of this Court that the approval granted for the petitioner's appointment was subsequently cancelled by order dated 08.07.2024, which has not been challenged by the petitioner. In view of the same, the relief sought in this writ petition cannot be granted. It is needless to state that the petitioner can challenge the order dated 08.07.2024 in the manner known to law.

5. Accordingly, this writ petition is dismissed. No costs 26-03-2026 Index: Yes/No Speaking/Non-speaking order MRP
