PRAYER:

Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider the petitioner for admission to MBBS course under SC reserved category in the unfilled surrendered seats and consequently select the petitioner in MBBS course for the academic year 2017-2018 as per the marks secured by the petitioner in National Eligibility Entrance Test (UG) - 2017 Examination.

O R D E R

The petitioner seeks for a mandamus directing the respondents to consider her under SC reserved category instead of UR category for admission to MBBS course in the unfilled surrendered seats and consequently, to select the petitioner in MBBS course for the academic year 2017-2018 as per the marks secured in NEET (UG) 2017 Examination.

2. Heard the learned counsel appearing for the petitioner, the learned Senior Central Government Standing Counsel appearing for the first respondent and the learned standing counsel appearing for the second respondent.

3. The case of the petitioner is that at the time of applying for NEET Examination, her category was wrongly shown as UR instead of SC, even though the petitioner belongs to SC category. Therefore, now the petitioner seeks to change her category from UR to SC and consider her for admission to MBBS course under such SC category.

4. Admittedly, the petitioner has approached this Court and filed the present writ petition only after publication of the merit list and commencement of the counselling. Apart from the above said fact, it is to be noted that the counselling is already over and the last date for admission is also over. Therefore, at this stage, the petitioner cannot seek any indulgence from this Court, by way of filing the present writ petition. Therefore, this Court, is not inclined to entertain this writ petition. Accordingly, the writ petition fails and the same is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
