ORDER

The prayer sought for in this writ petition is for a direction to the respondents to implement the order passed in W.P. No.14397 of 2013 dated 01.09.2015 and thereby to bring the petitioner under regular time scale together with service and monetary benefits with interest and to pass appropriate orders within a time frame to be fixed by this Court.

2. It is stated that the petitioner was appointed as sanitary worker on daily wages and is continuously working ever since from 1988 without any break under the 3rd respondent. In order to bring daily wages employees under regular time scale of pay, several G.O.'s have been issued by the Government during the year 1997 and 1998. Due to financial crunch, the fresh recruitment was banned in the year 2001 and thereby the 1st respondent directed the 2nd respondent to keep the process of regularisation of existing employees in abeyance and subsequently the general ban was lifted in the year 2006. It is the contention of the petitioner that contrary to the provisions, the 3rd respondent regularised the services of the petitioner and granted regular time scale of pay from 2006 instead of 1996. 3rd respondent, the petitioner and other similarly placed persons, had earlier filed a writ petition viz., W.P. No.14397 of 2013 before this Court and seeking a direction to bring the petitioner under regular time scale of pay with effect from 28.01.1996 and to grant consequential benefits by taking into account the consolidated service, in terms of G.O.Ms.Nos.199 and 84, dated 12.08.1997 and 21.05.1998.

3. It is further stated that the said writ petition in W.P.No.14397 of 2013 and etc. batch was allowed by the Hon'ble Division Bench of this Court by order dated 01.09.2015. However, till date, the said order has not been implemented by the respondents. Hence, the present writ petition has been filed seeking a direction to the 3rd respondent to implement the order passed by this Court in W.P.No.14397 of 2013 dated 01.09.2015.

4. Learned counsel for the petitioner submitted it would suffice, if this Court issues directions to the respondents to implement the order passed in W.P. No.14307 of 2013, dated 01.09.2015 with regard to regularisation of regular time scale of pay, within a time frame to be fixed by this Court.

5. Mr.C. Selvaraj, learned Additional Government Pleader appearing for the respondents 1 and 2 submitted that he has no objection for issuance of such a suitable directions by this Court.

Considering the limited scope of the prayer sought for in the present writ petition, this Court, without expressing any opinion on the merits of the case, directs the respondents to implement the order passed by this Court in W.P.No.14397 of 2013 dated 01.09.2015, unless the said order has been set aside in the manner known to law, within a period of four weeks from the date of receipt of a copy of this order.

7. With the aforesaid directions, this writ petition stands disposed of. No costs.
