This civil miscellaneous petition has been filed to condone the huge delay of 665 days in filing the appeal against the fair and decretal order dated 2.6.2017 passed in Probate Original Petition No.162 of 2010 by the learned Principal District Judge, Coimbatore.
2. Learned counsel for the petitioner submitted that after the impugned order was passed, the petitioner suffered increase in uric acid, as a result his right leg got stuck due to age old disease and he was unable to contact his counsel to give the appeal papers to be filed in time. In the meanwhile, the delay of 665 days has occurred.
3. But this Court is unable to accept the unacceptable reason for condoning the huge delay of 665 days. When the decretal order was passed on 2.6.2017, with almost two years delay, the petitioner cannot come to this Court. Hence, finding no sufficient cause, the prayer is refused and the civil miscellaneous petition stands dismissed.
