ORDER

Mr. L.P. Shanmugasundaram, learned Special Government Pleader, accepts notice for the respondents. With consent, this writ petition is taken up for final disposal, at the admission stage itself.

This writ petition has been filed seeking a writ of mandamus directing the 1st respondent to direct the 3rd respondent Management to pay and settle the petitioner's terminal benefits of Rs.6,51,420/- along with interest at the rate of 9% p.a. for the belated payment from the date of due on 01.04.2015 till its payment.

It is seen from the records that the petitioner was permitted to retire by order dated 31.03.2015 passed by the President of the 3rd respondent Cooperative Society. A perusal of the said order shows that there is no pendency of departmental proceedings or any due payable by the petitioner to the 3rd respondent society.

Therefore, the respondents ought to have disbursed the petitioner's terminal benefits, with interest, if there is any delay. As it has not been done, the petitioner has addressed a representation dated 13.04.2017 to the authorities, which is still under consideration.

In view of the above, the respondents are directed to consider the petitioner's representation dated 13.04.2017 on its own merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. With the above direction, this writ petition is disposed of. No costs.
