(RC.NO.7(A)/2003/CBI/ABC/CHENNAI) Petition praying that in the circumstances stated therein the High Court will be pleased to condone the absence of the petitioner to appear before the Honourable XI Additional Special Judge (CBI Cases relating to Banks and Financial Institutions, Chennai) on the first working day of August and September 2017 and consequently permit the petitioner to continue to comply with the above condition imposed on him by this Honourable Court in the order dated 30.07.2013 in Crl.M.P.No.1 of 2013 in Crl.A.Nos.507,508,509 & 510 of 2013 and pass any such or further orders.[CRL.MP.NOS.14760 TO 14763 OF 2017] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.M.MOHAMMED RAFI Advocate for the petitioner and of PUBLIC PROSECUTOR on behalf of the Respondent, the court made the following order:- These petitions have been filed to condone the absence of the petitioner on the first working day of August and September 2017, in compliance with the condition imposed by this Court, while granting bail.
2. Heard the learned counsel for the petitioner and the learned Special Public Prosecutor (CBI Cases) appearing for the respondent.
3. The petitioner has been scrupulously complying with the condition imposed by this Court. Hence, considering the reasons stated in the affidavit for non appearance on those two days, his
absence is condoned with the direction that henceforth, the petitioner shall comply with the condition without any fail.
4. Accordingly, the Criminal Miscellaneous Petitions are allowed. No costs.
