Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of mandamus to direct the respondents herein to consider the representations of the petitioner dated 7.3.2014 and 24.3.2014 in the light of the conclusion of the Government sent along with the letter dated 17.11.2004. ORDER

The petitioner while working as a Junior Assistant of Edapadi Panchayat Union, he was issued charge memo and after enquiry, the petitioner was imposed penalty of Rs.1,000/- by the 3rd respondent - District Collector, Salem in the Order dated 18.4.2005 pursuant to a disciplinary proceedings. The petitioner has approached the Government questioning the aforesaid order. According to the petitioner, the Government sent its proceedings dated 17.11.2004 that none of the charges are proved.

Based on the aforesaid proceedings, the petitioner made a representation to the District Collector to revoke the order dated 18.4.2005 and the District Collector passed an order dated 28.4.2014 that he would pass an order in terms of the order of the Government.

2. In view of the same, the 3rd respondent - District Collector is directed to pass an appropriate order as stated in his order dated 28.4.2014 within a period of four weeks from the date of receipt of copy of this order.

The writ petition is disposed of accordingly. However, there is no order as to costs.
