ORDER

The petition has been filed to direct the third and fourth respondents to promote the petitioner to the post of Sanitary supervisor in the 4th respondent town panchayat by considering the petitioner's representation dated 11.12.2025 and 07.01.2026 in accordance with law.

2. It is the case of the petitioner that he was initially appointed as NMR employee in the year 1996 and appointed as Sanitary worker in Bhuvanagiri Town Panchayat. While so, he was placed under suspension on 27.03.2021 for violating government servants election regulations. Later, he was exonerated from charges by an order dated 05.12.2025 passed by the fifth respondent.

3. But, to his shock and surprise, the 4th respondent has issued a provisional seniority list wherein the petitioner's name was rejected stating that charge memo is pending against him. Therefore, the petitioner made a representation dated 11.12.2025 to the fourth respondent stating that he had been exonerated from the said charges and no charge memo was pending

against him. Since no action was taken, he made a detailed representation dated 07.01.2026 to the third respondent, for which, there is no response till date. Therefore, the petitioner is before this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 3rd and 4th respondents to consider the petitioner's representation dated 11.12.2025 and 07.01.2026, on merits and in accordance with law and to pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.
