(CRIME No.08/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed in para No.6(a) in CRL.OP.NO.1303/2022 dated on 24/01/2022 and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.D.DAYALAN, Advocate for the petitioner and of MR.R.KISHORE KUMAR, Govt. Advocate ( Crl. Side)on behalf of the Respondent the court made the following order:- The present petition has been filed to modify the condition that each of the petitioner was directed to deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Crime No.08 of 2021 before the learned District Munsif cum Judicial Magistrate, Neyveli, imposed by this Court in Crl.O.P.No.1303 of 2022 dated 24.01.2022.

2. The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. He further submitted that the first petitioner is housewife, not earning any money and she belongs to very poverty and economically weaker person in society. The second petitioner is the son of first petitioner, he is unemployed. He further submitted that they are unable to mobilize the funds. 3. The learned Government Advocate (Crl.Side) submits that the petitioners have not complying with the conditions imposed by this Court.

4. Considering the facts and circumstances of the case, I do not find any reason to modify the conditions imposed by this Court because of the offences are grave in nature.

5. Accordingly, this Criminal Miscellaneous Petition is dismissed.
