ORDER

The petitioner, who was arrested on 22.02.2026 and remanded to judicial custody on 24.02.2026 for the alleged offences under Sections 318(4) of BNS (Section 420 of Indian Penal Code, 1860) and Section 66D of Information Technology (Amendment) Act, 2008 in Crime No.14 of 2026 on the file of the respondent police, seeks bail.

The case of the prosecution is that the defacto complainant, who was seeking overseas employment came across an advertisement made by the accused and uploaded her resume and paid a sum of Rs.7,76,893/- towards visa and other charges and later found that she was cheated by the accused persons. Hence, the case was registered.

The learned counsel appearing for the petitioner would submit that he has been remanded to judicial custody since 22.02.2026 and he has only developed the website for A1 and he has nothing to do with the prosecution case. It is further submitted that he is only a service provider and received only nominal amount for developing the website and has no knowledge about the alleged offence. Hence, he prayed for granting bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent would submit that with great difficulty they have secured the petitioner and he was remanded before the Delhi Court on 22.02.2026 and later produced before the jurisdictional Magistrate. It is further submitted that the petitioner by creating fake website, cheated the defacto complainant of Rs.7,76,893/- and the investigation is in preliminary stage. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submission of the learned Government Advocate (Crl. Side).

6. Considering the submission of the learned counsel on either side, it is seen that the petitioner by creating fake website, cheated the defacto complainant of Rs.7,76,893/-. Taking into account the allegation against the petitioner, the totality of the circumstances and the fact that the investigation is in the preliminary stage, this Court is not inclined to enlarge the petitioner on bail.
