A.No.1920 of 2024 in E.P.No.70 of 2021 P.VELMURUGAN , J., This application has been filed to extend the time for depositing the balance sale amount by the applicant in the above E.P.No.70 of 2021.

2. The applicant was the successful bidder in the court auction sale conducted on 01.03.2023 and he had already paid 25% of the upset price as per the conditions of the auction notice. Meanwhile, it is informed that the judgement debtor has filed an appeal in O.S.A.No.46 of 2023 before the Hon'ble Division Bench of this Court. Now, the dispute is pending before the Hon'ble Division Bench of this Court. No legal impediment would be caused to the applicant, if he pays the remaining amount.

3. Hence the applicant is directed to deposit the balance sale consideration to the credit of E.P.No.70 of 2021 before the Registry on or before 3rd June 2024, failing which, the applicant's right would be forfeited to pay the amount and the sale would be set aside.

4. List the matter on 4th June 2024.
