The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondent to settle the terminal 1/4

benefits with interest @ 10% for the belated payment to the petitioner.

2.The learned counsel appearing for the petitioner submitted that the petitioner who had joined the services of the respondent Corporation, had retired from service on 28.02.2019, however, the terminal benefits have not yet been settled except pension on the ground that un-implemented punishment was not implemented, however, un-implemented punishment cannot be implemented after retirement and the same was settled by the Madurai Bench of this Court in W.A.(MD) No.1270 of 2020 [The State Express Transport Corporation (Tamilnadu) Limited and three others Vs. G.Senthil and another] dated 15.06.2021.

3.The learned counsel appearing for the respondent submitted that the eligible terminal benefits will be settled in favour of the petitioner, within a reasonable time frame. 4.The petitioner had retired from service on 28.02.2019, however, the terminal benefits have not yet been settled except pension on the ground that un-implemented punishment was not 2/4

implemented, however, un-implemented punishment cannot be implemented after retirement. Hence, this Court directs the respondent to settle the terminal benefits due to the petitioner without referring to the un-implemented punishment, within a period of six weeks from the date of receipt of a copy of this order along with interest @ 6% per annum for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of terminal benefits of the petitioner.
