Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to fix the seniority of the petitioner as per Rule 35 (aa) of the TN State and Subordinate Service Rules in pursuance of the clarification issued by the Government in Letter No.73950/ B/2002-1 P&AR Department, dated 22.08.2003 and promote the petitioner as Desk Superintendent w.e.f. 2011 on the date on which the petitioner's juniors have been promoted based on the orders passed by this Court in Writ Petition No.15334/10, dated 30.06.2011 and the consequential proposal send by the 4th respondent in his Communication Na.Ka. No.9222/A1/2011, dated 03.08.2011, with due regard to seniority, service and all other monetary benefits For Petitioner :

ORDER

The petitioner is working as an Assistant in Education Department in Thiruvannamalai District.

2. Though the prayer in the writ petition is widely worded, the learned counsel appearing for the petitioner has submitted that the petitioner would be satisfied, if a direction is issued to the second respondent to pass orders on the proposals, relating to promotion to the post of Superintendent in Na.Ka. No.9222/A1/2011, dated 03.08.2011, of the fourth respondent, within a stipulated period.

3. Mr.V.Jeyaprakash Narayanan, learned Special Government Pleader takes notice for the respondents.

4. In view of the narrow prayer made, the Writ Petition is disposed of, directing the second respondent to pass orders on the proposal, dated 03.08.2011, of the fourth respondent, within a period of eight weeks from the date of receipt of a copy of this order.
