O R D E R

This Writ Petition has been filed to direct the third respondent to pay arrears of difference in wages by virtue of implementation of temporary status with effect from 05.04.1995 on par with similarly placed persons from the respective dates of eligibility of the petitioner, based on the petitioner's representations dated 02.11.2016 and 17.11.2017 respectively and other consequential benefits forthwith.

The learned counsel appearing for the petitioner submits that the petitioner joined in Oulgaret Municipality as daily rated Sanitary Worker on 07.10.1991 and his service was regularized on 14.02.2002. The grievance of the petitioner is that the Government of India formulated a scheme, namely, "Casual Laborers (Grant of Temporary Status and Regulations) Scheme of

Government of India, 1993, for the welfare of daily rated employees to grant temporary status and regularization of the services working in various departments and therefore, the petitioner is entitled to claim temporary status with effect from 1993, however, the same was not extended to the petitioner. Thereby, the present writ petition has been filed.

The learned Additional Government Pleader appearing for the respondents submits that an order has been passed on 08.11.2024 conferring temporary status to the petitioner with effect from 13.07.2000 and the respondents are also willing to give benefits to the petitioner from the year 2000 and a proposal was also forwarded by the third respondent Municipality to the Government and as soon as the order is received, benefits will be granted to the petitioner.

4. Recording the submission made by the learned Additional Government Pleader appearing for the respondents, this Writ Petition is disposed of with a direction to the first respondent to take decision on the proposal forwarded by the third respondent Municipality and extend the

benefit in favour of the petitioner from the year 2000 within a period of 12 weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
