Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the 2nd respondent to pay the Subsistence Allowance to the petitioner and to dispose the appeal dated 01.06.2015 filed by the petitioner to the 1st respondent at the earliest.

ORDER

The petitioner was placed under suspension by an order dated 15.10.2014 by the second respondent. He was ultimately terminated from service by an order dated 17.04.2015. The petitioner has filed an appeal before the first respondent against the aforesaid termination order.

2. Now, the petitioner has filed this writ petition seeking for a direction to the second respondent to pay him subsistence allowance for the period of suspension till he was terminated and also for a further direction to dispose of the appeal dated 01.06.2015, within a stipulated period.

3. Mr.S.Muthuraj, learned counsel takes notice for the respondents.

In view of the narrow prayer made, the Writ Petition is disposed of, directing the second respondent to pay subsistence allowance to the petitioner for the period of suspension, if the subsistence allowance was not paid already and a further direction is issued to the first respondent to dispose the appeal preferred by the petitioner dated 01.06.2015, within a period of two months from the date of receipt of a copy of this order.
