O R D E R

This Criminal Original Petition has been filed to direct the Court of Chief Judicial Magistrate, Erode to grant the certified copies of the Documents referred to in Serial Number 3 to 9 in the list of the documents to be furnished to the accused.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 3.The learned Additional Public Prosecutor submitted that on submission of final report filed by the Investigating Officer, the case was taken on file in C.C.No.255 of 2014 and as per mandate of section 207 Cr.P.C. copies of statement of all the witnesses and all documents relied upon by the prosecution including the alleged confession statement of accused No.1 and 2 https://hcservices.ecourts.gov.in/hcservices/

were furnished to the petitioner as per mandate of section 207 Cr.P.C. Hence in the considered opinion of the Chief Judicial Magistrate Court, absolutely there is no need to give certified copies of the same.

4. Considering the facts and circumstances of the case, the petitioner is directed to represent the copy application after complying the corrections pointed out by the Court below. On receipt of such application, the trial Court is directed to consider the application and pass orders on merits and in accordance with law. Registry is directed to return the original copy application in C.A.No.441 of 2018 along with docket order dated 03.09.2018 after getting necessary attested copies and signature.

5. With the above directions, this Criminal Original Petition is disposed of.
