When the case came up for hearing on an earlier occasion, the learned Counsel for the Respondent reported that the Revision Petitioner died. At that time, the learned Counsel for the Revision Petitioner sought adjournment to clarify. Accordingly, the case was adjourned to 21.04.2023.

2. Today (21.04.2023), when the case came up for hearing, the learned Counsel for the Revision Petitioner had filed C.M.P.No.8031 of 2023 to set aside the abatement caused due to the death of the sole petitioner, C.M.P.No.8034 of 2023 had been filed to bring on record the legal heirs of the Revision Petitioner and C.M.P.No.8029 of 2023 had been filed to condone the delay of 212 days in filing the petition to bring on record the legal heirs of the Revision Petitioner.

3. The learned Counsel for the Respondent is present in Court and he fairly concedes the same and he has no objection.

4. In view of the above, the Civil Miscellaneous Petitions are allowed.

5. Registry is directed to carryout the necessary amendment in the cause list.

6. Post this case after four weeks.
