Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandamus directing the 1st respondent to consider the petitioner's representation dated 09.05.2015 in the light of the proceedings in Na.Ka. 13138/2014/PC.2 dated 06.03.2015 and thereby direct the 2nd respondent to take suitable departmental action against the 3rd respondent for non-furnishing of the information requested by the petitioner under Right to Information Act through his representations dated 17.04.2014 and 18.06.2014. In this writ petition, the petitioner has sought two prayers, the first prayer is for a direction to the 1st respondent to consider his representation dated 09.05.2015 by taking note of the proceedings Na.Ka. 13138/2014/PC.2 dated 06.03.2015 and the second prayer is to direct the 2nd respondent to take departmental action against the 3rd respondent. 2.
Insofar as the second prayer sought by the petitioner is concerned, learned Government Advocate appearing for respondents 1 and 2 submitted that by proceedings dated 29.04.2015, show cause notice has been issued to the 3rd respondent by the 2nd respondent. Hence, the second prayer has been satisfied.
As far as the first prayer sought by the petitioner is concerned, taking note of the pendency of the representation of the petitioner dated 09.05.2015, the 1st respondent is directed to consider the said representation and pass orders, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
