(Order of the Court was made by PARESH UPADHYAY, J.) Challenge in this appeal is made to the judgment and decree dated 24 October 2019 passed by learned I Additional District Judge, Coimbatore in O.S.No.566 of 2011.

2. Heard the learned advocate for the petitioners and the learned advocate for the respondent/original plaintiff (employer).

3. The principal controversy is that, the suit for recovery was filed by the bank - not as a lender of money but as an employer for recovery of amount, which was allegedly defrauded by its employee, who, during the pendency of the proceedings, died. Whether the legal heirs can be legally asked to disprove the case of the employer, would be a question to be gone into.

4. It is ordered that during the pendency of the appeal, the impugned judgment and decree shall remain stayed.

5. Liberty reserved to the parties to move the Court for early hearing of the appeal.
