This Criminal Original Petition has been filed to direct the learned Judicial Magistrate - II, Puducherry to complete the trial proceeding in C.C.No.984 of 2005, within a time frame.
2. Heard Mr.M.Gnanasekar, learned counsel for the petitioner and Mr.V.Balamurugane, learned Additional Public Prosecutor (Pondicherry) for the respondent.
3. Today, when the matter is taken up for hearing, Mr.V.Balamurugane, learned Additional Public Prosecutor (Pondicherry) submitted that the petitioner had filed an application for discharge from the case and the same is pending from the year 2019 and the delay caused is only due to the petitioner.

4. In such a view of the matter, this petition for expeditious trial is nothing but an abuse of process of law.
5. Accordingly, this Criminal Original Petition is dismissed. The learned Judicial Magistrate - II, Puducherry, shall dispose of the trial proceeding in C.C.No.984 of 2005, within a period of one month from the date of receipt of a copy of this order.
