Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 3 and 4 to provide adequate police protection for doing agricultural work in the land of the petitioner in survey No.762/B1 situated at Mangalapuram village, Padavedu

Mathura, Polur Taluk, Thiruvannamalai District on the basis of the petitioner's representation dated 12.02.2025.

For Petitioner : Mr.G.Pavendhan For R1 to R4 : Mr.A.Gopinath Government Advocate (Crl.side) O RDER This Writ Petition has been filed for direction directing the respondents 3 and 4 to provide adequate police protection for doing agricultural work in the land of the petitioner in survey No.762/B1 situated at Mangalapuram village, Padavedu Mathura, Polur Taluk, Thiruvannamalai District on the basis of the petitioner's representation dated 12.02.2025.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondents 1 to 4 and perused the materials available on record.

3. The petitioner owned property comprised in Survey No.762/B1 situated at Mangalapuram village, Padavedu Mathura, Polur Taluk, Thiruvannamalai District. However, the 5th respondent is also claiming right over the property and interfering with the possession of the petitioner's property.

4. Therefore, though the petitioner obtained a decree as against the 5th respondent and when the appeal is also pending before the appellate Court, the petitioner ought to have approached the Civil Court for appropriate relief for violating the order passed by the Civil Court by the 5th respondent.

5. In view of the above, the direction sought for in this petition cannot be granted and the writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. No costs. 21.04.2025 Internet: Yes Index : Yes/No Speaking/Non Speaking order mn
