CMP Nos.11073, 11068 and 11064 of 2021 have been filed by the petitioners i)to condone the delay of 215 days in filing the petition to set aside the abatement caused due to the death of the 1st appellant; ii) to set aside the abatement caused due to the death of the 1st appellant and iii) to bring on record the legal representative of the deceased 1st appellant in the above Second Appeal.

2. Heard M/s.V. Balasubramanian Associates, learned counsel for the petitioners.

3. The learned counsel appearing for the respondents has no objection for allowing these petitions.

4. Having regard to the reasons stated in the affidavit filed in support of these petitions and this Court being satisfied with the same, these CMPs are allowed as prayed for.
