O R D E R

This criminal original petition has been filed to direct the 2nd respondent to register FIR on the petitioner's complaint dated 27.02.2015 in CSR No.171/CSR/FIPS/2015 dated 03.03.2015 in accordance with law.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is seen that when the petitioner's brother was in jail, his shop was stolen by the opposite parties. The petitioner lodged a complaint on 27.02.2015 and the opposite parties appeared before the police and undertook to amicably settle with the petitioner. However, the learned counsel for the petitioner submits that the opposite parties are continuing to cause disturbance to the petitioner.

4. Under such circumstances, the respondent police is directed to conduct enquiry in CSR No.171 of 2015 and take action in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)]..

5. In view of the above, the criminal original petition is closed.
