ORDER
While the petitioner was working as Conductor in Tamil Nadu State Transport Corporation at Dharmapuri, the first respondent initiated disciplinary proceedings against him. The first respondent passed an order on 23.07.2012. The said order was challenged before the second respondent. The appeal was not taken up for consideration. The petitioner therefore sought information under the Right to Information Act. The petitioner was informed that no such appeal was pending. The petitioner therefore has come up with this writ petition for a direction to the second respondent to dispose of the appeal filed on 17.09.2012 on merits.
2. The documents available on record shows that the appeal was received by the second respondent on 2.11.2012. Therefore, it is clear that the appeal was preferred by the petitioner within the cut https://hcservices.ecourts.gov.in/hcservices/
off date. The issue therefore requires to be considered by the second respondent.
3. The second respondent is directed to consider and dispose of the appeal filed by the petitioner on 17.9.2012, on merits and as per law. Such exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.
4. The petitioner is directed to forward a copy of the appeal memorandum and the postal acknowledgment, so as to enable the second respondent to decide the matter as expeditiously as possible.
5. The writ petition is disposed of with the above direction. No costs.
