Respondent(s) PRAYER: This writ petition has been filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus to call for the records of the 2nd respondent in its Addendum Notification No. 02 -A/ 2024 dated 27.04.2024 to the Principal notification No.02/2024 dated 14.03.2024 insofar as it states that the candidates who are going to appear for Tamil Nadu State Eligibility Test (TNSET) 2024 to also apply for recruitment to the post of Assistant Professor in Government Arts and Science Colleges

and Government Colleges of Education in the Tamil Nadu Collegiate Educational Service to be filled up by direct recruitment pursuant to the notification No.02/2024 dated 14.03.2024 and to quash the same as being illegal and unsustainable in law and for a consequential direction to the respondents to proceed with the recruitment by only processing the applications of those persons who are eligible as per clause 6 of the notification as on the date of the notification.

ORDER

The writ petition has been filed in the nature of a Certiorarified Mandamus seeking records relating to an Addendum Notification No. 02A/2024, dated 27.04.2024, to the Principal Notification No.02/2024, dated 14.03.2024, with respect to one clause, namely, the candidates who are going to appear for the Tamil Nadu State Eligibility Test (TNSET) 2024 may also apply for the recruitment to the post of Assistant Professor in Government Arts and Science Colleges and Government Colleges of Education in Tamil Nadu Collegiate Educational Service, which has to be filled up by direct recruitment.

2.The writ petition has been filed on the apprehension that the respondents will open up the floodgates to even those who had not qualified in (TNSET) 2024 to also apply and compete along with the petitioner, who incidentally claims to have qualified in that particular test for direct recruitment to the post of Assistant Professor in Government Arts and Science Colleges and Government Colleges of Education. But, unfortunately, the respondents have no way of going forward with the recruitment, particularly because of the notification issued/Notification No.02/2024, dated 14.03.2024, had been issued in accordance with G.O.(Ms) No.246, G.O.(Ms) No.247 & G.O.(Ms) No.248, Higher Education (F2) Department, all dated 08.11.2022. 3.

The learned Additional Advocate General pointed out that the Addendum Notification stated by the petitioner in the relief to the writ petition/ No. 02A/2024 itself was challenged and the challenge ended in dismissal. But however, a further challenge has been made to two of the above mentioned three Government Orders and the Court had quashed two Government Orders out of three. It is stated that the respondents have now filed Writ Appeal.

path is cleared with respect to the aforementioned three Government Orders, I do not find any way in which the respondents could go forward and proceed with the Notification No.02/2024.

4.The writ petition therefore stands closed at present. The writ petitioner being vigilant can always file a fresh writ petition whenever further information is divulged on this aspect. No Costs. Consequently, connected miscellaneous petitions, if any, are also closed.
