PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Certiorarified Mandamus calling for the entire records pertaining to the issuance of the impugned order dated 12.01.2026 in Na.Ka.No. 1492/ A/ E.O- 6/ 2025 passed by the 4th respondent herein and quash the same consequently direct respondents 1 and 2 to execute rectification deed or any other necessary deed based on the petitioners representation dated 5.11.2025 and 3.01.2026. ORDER

The present Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus calling for the entire records pertaining to the issuance of the impugned order dated 12.01.2026 in Na.Ka.No. 1492/ A/ E.O- 6/ 2025 passed by the 4th respondent herein and quash the same consequently direct respondents 1 and 2 to execute rectification deed or any other necessary deed based on the petitioner's representation dated 05.11.2025 and 03.01.2026.

2. The learned counsel for the petitioner submitted that the petitioner's husband was allotted a housing site by the Tamil Nadu Slum Clearance Board. After the demise of the petitioner's husband, the petitioner paid the entire amount due to the Slum Clearance Board, and consequently, the Board executed a Sale Deed in favour of the petitioner. Thereafter, the petitioner sold the said property in favour of one Duraisamy vide registered Sale Deed dated 11.03.2019 in Document No.803 of 2019. However, in the original Sale Deed, the Block Number and Town Survey number were erroneously mentioned as Block No.114 and T.S.No.150 instead of "Block No.108 and T.S.No.120".

3. For rectification of the said error, the purchaser made an application before the respondents, however, the respondents refused to rectify the same. Subsequently, the petitioner also made a representation, which is yet to be disposed of by the respondents. Aggrieved by the same, the present Writ Petition has been filed.

The learned counsel for the petitioner further submitted that the petitioner, being the vendor and the original allottee, is willing to execute the rectification deed in coordination with the respondents/Slum Clearance Board before the jurisdictional Sub-Registrar Office. Hence, this Court may issue a

direction to the respondents to facilitate execution of a rectification deed to correct the error in the Original Sale Deed bearing Document No.1468 of 2013 on the file of the Sub Registrar, Ashok Nagar and thereafter permit execution of a consequential rectification deed between the petitioner and the purchaser, namely, Duraisamy. Accordingly, he prayed for appropriate orders.

5. The learned Standing Counsel appearing for the respondents submitted that the respondents are ready to cooperate with the petitioner for rectification of the original Sale Deed bearing Document No.1468 of 2013, dated 26.04.2013.

In view of the submissions made by the learned Standing Counsel appearing for the respondents, there shall be a direction to the petitioner and the respondents to present the rectification deed before the jurisdictional Sub Registrar for rectifying the error committed in Document No.1468 of 2013. Upon such presentation, the jurisdictional Sub Registrar shall register the same after collecting the requisite fees. Thereafter, the petitioner and the purchaser shall be at liberty to execute and register the consequential rectification deed in respect of Document No.803 of 2019, dated 11.03.2019.

7. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
