..Respondent(s) PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to pay difference in leave salary and difference in pension arrears with 10 percent interest as per 14th wage settlement dated 24.08.2022 difference in wage for the period from 01.09.2019 to 30.04.2020 and difference in leave salary based on 4 percent D.A. increase to the petitioners.

ORDER

The writ petition is filed for the relief set out below: "directing the respondents to pay difference in leave salary and difference in pension arrears with 10 percent interest as per 14th wage settlement dated 24.08.2022 difference in wage for the period from 01.09.2019 to 30.04.2020 and difference in leave salary based on 4 percent D.A. increase to the petitioners."

2. It is the case of the petitioners that at the time of retirement, they were working as "Special Grade Conductor, Special Grade Drivers and Selection Grade Driver" in the Respondent Corporation. After their settlement, the

respondent settled their terminal benefits based on salary paid on various dates. While so, the 14th wage settlement was arrived on 24.08.2022 and wage revision was given effect from 01.09.2019. Therefore, the respondent has to revise the pension difference in leave salary, however, the revised pension arrears were not fully settled. It is the contention of the petitioner that the Dearness Allowance was revised from 17% to 21% of basic pay.

3. The petitioners had made a representation to the respondents to pay them the differential payment with 10% interest. However, the same had not been considered to date by the respondents. Hence, the petitioners are before this Court.

4. Heard the learned Counsel on either side and perused the records.

Considering the limited request of the petitioners and taking note of the fact that the petitioners' representation has not been considered to date by the Respondents, a mandamus, is therefore, issued with following directions; (a) the respondents are directed to pay the difference in leave salary and difference in pension arrears with 6% interest as per 14th wage settlement dated 24.08.2022;

(b) the respondents are directed to consider and pass orders on the petitioners' representations in respect of difference in wage for the period from 01.09.2019 to 30.04.2020 and difference in leave salary based on 4% D.A.

increase, within a period of four weeks from the date of receipt of a copy of this order.
