Aggrieved against the common award passed by the Tribunal, the petitioner/Insurance Company/1st respondent has preferred the above appeals. After admitting the appeals, this Court passed an order of interim stay on condition that the appellant/Insurance Company shall deposit 50% of the award amount in each cases to the credit of M.A.C.T.O.P.Nos.5728 of 2011 and 5858 of 2011 on the file of the Motor Accident Claims Tribunal, VI Judge, Court of Small Causes, Chennai.

2.Now, the miscellaneous petitions are filed by the claimants seeking to permit the petitioner(s) to withdraw the deposited amount Rs.5,53,760/- and Rs.4,03,002/- to the credit of MACTOP Nos.5728 and 5858 of 2011 respectively. 3.Learned counsel for the petitioners/claimants would submit that due to the accident, the petitioner(s) sustained grievous injuries and they are unable to do any kind of work and there is no other source of income to meet their debts. If this Court does not permit to withdraw the deposited amount, they will put to great hardship.

4.Learned counsel for the first respondent/Insurance Company has not raised any objection in allowing these petitions. 5.In view of no objection raised by the learned counsel for the first respondent/Insurance Company, these petitions are allowed as prayed for. 18.11.2016 kal
