O R D E R

(The case has been heard through video conference) The petitioner who apprehend arrest at the hands of the respondent police for the alleged offences punishable under sections 35 of Tamil Nadu Forest Act 1882 and under Rule 9 & 10 of Tamil Nadu Timber Transit Rule 1968 in STOR No.2 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 18.02.2020, when the respondent conducted vehicle check up, found the petitioner illegally transporting 44 pieces of red sandal woods through Ashok Leyland vehile. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner is a habitual offender and two previous cases have been against him for similar offences. He would further submit the case in Crime No.412 of 2012 was registed against the petitioner by the Pathirivedu Police Station for illegally transporting 25 tons of red https://hcservices.ecourts.gov.in/hcservices/

sanders and another case in Crime No. 202 of 2013 was registered for having transported 329 pieces of red sanders in three lorries. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the bad antecedents of the petitioner in involving in cases of similar nature, this Court is not inclined to grant anticipatory bail to the petitioner.Accordingly, this Criminal Original Petition stands dismissed.
