(Order of the Court was made by R.SURESH KUMAR, J.) The prayer sought for herein is for issuance of a writ of mandamus directing the Debts Recovery Tribunal-III, Chennai to expeditiously hear and dispose of S.A.No.92 of 2025.
2. It is the grievance of the petitioner herein who is the respondent before the Debts Recovery Tribunal in S.A.No.92 of 2025 on the file of the Debts Recovery Tribunal-III, Chennai to take up the said S.A and expeditiously decide it for which an advance hearing though had been filed, still the case is not taken up.
3. Be that as it may, depends upon the work load before the Debts Recovery Tribunal-III, the dates normally would be given by the Debts Recovery Tribunal. When that being so, if a special attention is sought to be given in respect of one particular matter by issuing Mandamus by this Court under Article 226 of the Constitution of India, that will set a bad precedent as several earlier applications pending before the very same Debts Recovery 2/4
Tribunal would be overlooked by passing such kind of order to take up the particular S.A.No.92 of 2025 alone, therefore, we are not inclined to entertain this Writ Petition, hence it is dismissed. However, the dismissal of this writ petition will not preclude the petitioner to pursue his advance hearing petition which has already been filed before the Debts Recovery Tribunal-III by the petitioner.
