Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, directing the first respondent to pass order on the petitioner's appeal dated 20.06.2019 within a stipulated period as fixed by this Hon'ble Court.

ORDER

(Heard through Video Conferencing) The petitioner was proceeded with disciplinary action and on completion of the departmental action, the petitioner was imposed with the penalty on 16.03.2019 by the second respondent. According to the petitioner, he has preferred an appeal to the first respondent on 20.06.2019 and unfortunately, the appeal has still not been disposed of.

2. In the above circumstances, the petitioner is before this https://hcservices.ecourts.gov.in/hcservices/

Court seeking direction to the first respondent to dispose of the appeal pending, within a time frame to be fixed by this Court.

3. When the matter is taken up for admission, Mr.Sajeev Kumar, learned Special Government Pleader appeared on behalf of the respondents and he would submit that if any direction is issued by this Court for disposal of the appeal, the same would be complied with.

4. This Court is of the view that, as prayer in the Writ Petition is of a very limited scope, no purpose would be served in keeping the matter pending on the file of this Court and therefore, the Writ Petition is disposed of at the admission stage itself by giving the following direction:- The first respondent is hereby, directed to dispose of the statutory appeal preferred by the petitioner dated 20.06.2019 within a period of three months from the date of receipt of a copy of this order on merits and in accordance with law.

5. With the above direction, this Writ Petition stands disposed of. No costs.
