Directing the 3rd Respondent to survey the properties, which is properties situated in survey No.64/18 to the extent of 0.24.11 ares and survey No.64/20 to the extent of 0.43.5 to the total extent of 67.16 ares which is situated at West Street, Govindamalayam Post, Thalaivasal Taluk, Salem district based on the representation of the petitioner dated 17.11.2025 with aid of the 4th respondent police within stipulated time may be fixed by this Honble court. Mr.R.P.Murugan Raja, Government Advocate for R1 to 3 Mr.V.Meganathan, Government Advocate (Crl.side) notice dispensed with for R5 to 10 Order This writ petition has been filed seeking for a direction to the third respondent to survey and demarcate the property, which according to the petitioner is owned by him, based on his representation dated 17.11.2025, within a time frame to be fixed by this Court.
2. The petitioner had submitted his representation dated 17.11.2025 for the aforesaid purpose. Since the same has not been considered till date, the petitioner has filed this writ petition.
3.Mr.R.P.Murugan Raja, learned Government Advocate accepts notice on behalf of respondents 1 to 3. Mr.V.Meganathan, learned Government Advocate
(Crl.side) accepts notice on behalf of the fourth respondent. Since no adverse order is being passed against respondents 5 to 10, notice to respondents 5 to 10 is dispensed with.
4.This Court is not expressing any opinion on the merits of the petitioner's representation.
5.No prejudice will be caused to the third respondent if the said authority is directed to survey and demarcate the boundaries of the petitioner's property, morefully described in the prayer to this writ petition, after hearing the objections if any from respondents 5 to 10 as well as any other party whom the third respondent deems it fit. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the third respondent is directed to issue notice to respondents 5 to 10 and also to any other party, whom the third respondent deems it fit to put on notice.
(b) After receiving objections if any and after considering the same, the third respondent shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance
with law, within a period of 12 weeks from the date of receipt of a copy of this order.
(c) If the need arises for police assistance and on a request made by the third respondent, the fourth respondent shall render police assistance for the effective implementation of this order.
