[R3 Suo mottu impleaded vide order dated 24.07.2020 made in 9617/2020 by NAVJ] PRAYER IN ALL W.Ps.: Writ Petitions filed under Aricle 226 of Constitution of India, seeking Writ of Mandamus, directing the respondents to consider the representation given by the petitioners dated 31.12.2018 and issue patta in favour of the petitioners in respect of the property bearing Survey No.11A/7B, No.1, Shivan Koil, Kulakarai Street, Villivakkam, Chennai District.

ORDER

All these writ petitions have been filed for a direction to the respondents to consider the representation made by the petitioners on 31.12.2018 and issue a patta in favour of the petitioners with respect to the subject property.

2. The case of the petitioners is that the property belongs to their father and after his demise, the petitioners are entitled to the property. The petitioners made a representation to the respondents, the same was not considered and the present writ petitions have been filed before this Court seeking for appropriate directions.

3. Heard Mr.A.K.R.Ravi, learned counsel for the petitioner, Mr.K.Parameswaran, learned Government Advocate for the first and second respondents and Mr.S.N.Parthasarathy, learned counsel for the third respondent.

4. Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in these writ petitions, there shall be a direction to the second respondent viz., Thasildar to consider the representation made by the petitioners on 31.12.2018 and deal with the same in accordance with law. It is also seen that the District Collector has already forwarded the representation to the Tahsildar by communication dated 23.01.2019. The Tahsildar shall issue notice to the Executive Officer, Arulmigu Agasthiswarar Kovil, Villivakkam, before conducting the enquiry and passing final orders. The Tahsildar is directed to pass final orders, within a period of twelve(12) weeks from the date of receipt of a copy of this order. The petitioners are directed to make a fresh representations along with all relevant documents and also a copy of this order.

All the writ petitions are disposed of with the above direction. No costs.
