Defendants Civil suit filed under Order IV Rule 1 Original Side Rules read with Order VII Rule 1 of C.P.C. praying that this Hon'ble Court be pleased to pass a judgment and decree:- a) directing the defendants to pay a sum of Rs.4,75,08,399/- (Rupees four crores seventy five lakhs eight thousand three hundred and ninety nine only) towards the amount borrowed and the interest thereon compounded; b) award an interest at the rate of 18% per annum on Rs.4,75,08,399/- (Rupees four crores seventy five lakhs eight thousand three hundred and ninety nine only) from the date of the plaint to the date of realisation; c) directing both the defendants to pay the cost of the suit.
This suit coming on this day before this court for hearing in the presence of Ms.Sunita Kumari, Advocate for the plaintiff herein, and the defendants herein not appearing in person or by advocate and upon reading the plaint filed herein, and the learned counsel for the plaintiff having submitted that the matter has been settled in between the parties out of court, it is ordered as follows:- That the suit in C.S. No.428 of 2015 be and is hereby dismissed as settled out of court.
2. That a certificate under Section 69 of The Tamil Nadu Court Fees and Suits Valuation Act XIV of 1955 (Amended Act), do issue herein, out of under the seal of this Court in favour of M/s.Sree Gokulam Chits & Finance Co., (P) Ltd., rep. by its Executive Director, G.Baiju, the plaintiff herein, authorising them to receive from the Pay and Accounts office, High Court, Chennai, a sum of Rs.4,78,610/- (Rupees four lakhs seventy eight thousand six hundred and ten only) being the entire court fee paid on the plaint by the plaintiff herein.
3. That the connected applications if any do stand closed.
4. That there shall be no costs of this suit. WITNESS THE HON'BLE MS.INDIRA BANERJEE, CHIEF JUSTICE, HIGH COURT AT MADRAS AFORESAID, THIS THE 20th DAY OF JUNE 2018.
