The grievance of the petitioner is that even without notice or summons, he has been called to the Mangadu Police Station for enquiry and harassed under the guise of enquiry. According to the petitioner, when he was called for enquiry, he asked the respondent police for what he was called for, but instead of disclosing the reason, he had been asked to stay in the station for hours together and they had also taken away the two-wheeler of his wife without assigning any reason.
2. The Learned Government Advocate (Crl.Side) for the respondent based on the complaint given by one Ramesh alleging that the petitioner and his wife has removed the electrical wire from their house, the complaint has been registered in C.S.R.No.522 of 2024 on 05.02.2024 and in this connection, the petitioner was called for enquiry instead of participating in the enquiry, he has filed this petition.
3. The photographs collected through CCTV footage have also been shown to the Court which indicates the involvement of the petitioner's Page No.2/4
wife and the two wheeler in the alleged incident.
4. In the light of the above fact, this Court finds that the petitioner, who is supposed to participate in the enquiry instead of participating in the enquiry has come to this Court with certain allegations against the police which is unfound.
5. Hence, this Criminal Original Petition is dismissed with direction to the respondent police to cause summons to the petitioner herein for appearance and conduct investigation in the manner known to law. 30.04.2024 Index : Yes/No.
