Defendant Civil Suit filed under Order IV Rule 1 of O.S. Rules read with Order VII Rules 1 and 2 of CPC seeking the following reliefs:- (a) Partition, separate possession of the suit schedule mentioned property by metes and bounds and allotting the plaintiffs 1 to 4, half share (4 ground 217 sq.ft each out of 8 grounds 433 sq.ft) in the suit schedule mentioned property.

(b) to appoint advocate to demarcate the suit schedule mentioned property by metes and bounds; and (c) costs of the suit.

JUDGMENT

The plaintiffs filed the suit against the defendant praying for a decree of partition of the suit property and allotment of their half share with separate possession and enjoyment.

The parties have settled the matter amicably and entered into a joint memorandum of compromise. 3.

The joint memorandum of compromise dated 15.04.2016 contains the terms and conditions of settlement.

The plan annexed to the joint memorandum of compromise indicates that the property marked as 'B' having an extent of 9865.698 sq.ft is allotted to the

share of the plaintiffs. The property marked as 'C' having an extent of 9864.028 sq.ft is allotted to the share of the defendant.

The plaintiffs and the defendant appeared before me and confirmed the factum of compromise and execution of joint memorandum of compromise.

The suit is decreed in terms of the joint memorandum of compromise. The joint memorandum of compromise dated 15.04.2016 and the plan shall form part of the decree. The plaintiffs are entitled to refund of Court Fee as per rules. No costs. Consequently, connected Application is closed.
