Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondent herein to sanction and grant incentive increment to the petitioner for acquiring Post Graduate degree namely M.E. in (Energy Engineering & Management) with effect from 23.06.2012, the date on which the petitioner had passed the Post Graduate degree.

The petitioner has filed this petition seeking a writ of mandamus, directing the respondent to grant an incentive increment to him for acquiring Post Graduate degree namely M.E. in (Energy Engineering & Management) with effect from 23.06.2012.

Heard Mr.A.R.Suresh, learned counsel for the petitioner and perused the materials available on record.

There is no representation for the respondent either in-person or through his counsel.

The petitioner, who was appointed as a Lecturer in the respondent University has completed the Post Graduation in Engineering and secured M.E. degree in May, 2012. The basic qualification required for his appointment is only a Bachelor degree in Mechanical Engineering. Hence his acquisition of Post Graduation is a higher qualification for the post. 5.

As per G.O.(Ms).No.350, Higher Education (H1) Department, dated 09.09.2009, the petitioner is entitled to get an incentive increment for 2/4

completing the higher qualification after joining service. In this regard, the petitioner has given a representation to the respondent to consider his request. But so far no order has been passed by the respondent. Aggrieved over the same, the petitioner has filed this petition. 6.

Since the petitioner supports his claim on the basis of G.O.(Ms).No.350, Higher Education (H1) Department, dated 09.09.2009, I feel it is appropriate to direct the respondent to consider the claim of the petitioner and pass appropriate orders, on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.
