ORDER

This writ petition has been filed for issue of Writ of Mandamus directing the second respondent to act upon the online application submitted by the petitioner on 11.06.2019, wherein the petitioner has sought for issuance of patta in his name with respect to the subject property.

2. Heard Ms.Gopika Nambiar, learned counsel appearing for the petitioner and Mr.A.Selvendran, learned Special Government Pleader for respondents 1 and 2.

3. With respect to the claim seeking patta in his name, the petitioner placed reliance upon the registered sale deed dated 25.08.2008, registered as Document No.5068/2008. The petitioner also placed reliance upon the judgment and decree dated 18.03.2013 in O.S.No.174 of 2012 on the file of the Additional Sub Court, Tindivanam, inter alia, filed for declaration and permanent injunction by the petitioner against the third respondent and her husband, and 2/5

that suit was decreed in his favour. The grievance of the petitioner is that the application submitted by him for issuance of patta did not result in passing any order in his favour and that the patta still stands in the name of the third respondent.

4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the second respondent to deal with the application submitted by the petitioner in line with BSO 31 [4(iii)] and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.
