A.No.3820 of 2024 in C.S(Comm.Div.)D.No.21873 of 2023 P.VELMURUGAN, J This application has been filed to condone the delay of 316 days in representing the plaint for the above suit in D.No.21873 of 2023.

2. The learned counsel for the applicants submits that the Registry returned the plaint on 28.12.2023 during the court vacation. The applicants did not collect the returned plaint immediately. Once the court reopened, they obtained the plaint and, after complying with the requirements specified in the return, they resubmitted it, which led to a delay of 316 days. This delay was neither willful nor wanton.

3. Though this Court is not fully satisfied with the reasons stated in the affidavit filed in support of this application, in the interest of justice and to provide one more opportunity to the applicants, the delay is condoned. Accordingly this application is ordered. 29.07.2024 r n s Note: The Registry is directed to number the suit, if it is otherwise in order.
