No.84 of Ward No.F. Block No.10 Adambakkam Village, Alandur Taluk and Town Previsouly Chengalput District presently Chennai District by taking note of the DTCP layout approved No.LPDM/D.D.T.P.No.90/70 and Sale Deed dated 19.10.1974 registered as document No.1794 of 1974 on the file of the SRO Alandur on the basis of application and acknowledgement dated 25.01.2025 and consequently forbearing the respondents from interfering or initiating any action in respect of excluded portion of land area measuring 296.64 sq.ft. left out in the patta. Mr.C.Jayaprakash, Government Advocate for R1 to 5 Notice dispensed with for R6 & 7 Order This writ petition has been filed to direct respondents 1 to 5 to modify patta No.788 standing in the name of the petitioner by including the short fall extent of 296.64 sq.ft. in Plot No.5 in the property, morefully disclosed in the affidavit filed in support of this writ petition, within a time frame to be fixed by this Court.
2.According to the petitioner, the aforesaid extent of 296.64 sq.ft. has been inadvertently left out in patta No.788 standing in the name of the
petitioner. The petitioner claims that he had made several representations and also filed revision petition before the Settlement Officer, Thanjavur seeking for modification of patta No.788 since the papers were misplaced. The petitioner claims that the revision petition filed by the petitioner was not adjudicated by the Settlement Officer, Thanjavur. In view of the same, the petitioner has now given a representation to respondents 1 to 5 seeking for modification of patta No.788 standing in the name of the petitioner to include the short fall extent of 296.64 sq.ft. Since the same has not been considered, this writ petition has been filed.
3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of respondents 1 to 5. Since no adverse order is being passed against respondents 6 and 7, notice to respondents 6 and 7 is dispensed with by this Court.
4.No prejudice would be caused to the respondents if the petitioner's representation, as stated supra, is considered, on merits and in accordance with law, after hearing the objections of respondents 6 and 7 and any other third party whom the fourth respondent deems it fit to enquire and after giving due consideration to the supporting documents produced by the respective parties, within a time frame to be fixed by this Court.
5.This Court is not expressing any opinion on the merits of the petitioner's representation.
6.For the foregoing reasons, this writ petition is disposed of by directing the fourth respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 25.01.2025 seeking for modification of patta No.788 for the property, morefully described in the affidavit filed in support of this writ petition by including the short fall extent of 296.64 sq.ft., after giving due consideration to the supporting documents produced by the petitioner and after hearing the objections of respondents 6 and 7 and any other third party whom the fourth respondent deems it fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. Consequently, connected WMP is closed. No costs.
