Respondent Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure to withdraw the H.M.O.P.No.18 of 2019 on the file of the Subordinate Court, Mettur and to transfer the same to be tried along with Subordinate Court, Hosur in H.M.O.P.No.67 of 2019.
For Petitioner ::
Mr.C.Prabakaran For Respondent ::
Mr.V.Sekar
ORDER
When the matter was taken up, the learned counsel for the respondent, placing on record a copy of the application memo dated 11.7.2019, stated that the respondent has withdrawn the H.M.O.P.No.18 of 2019.
2. Since the H.M.O.P.No.18 of 2019 filed by the respondent before the Sub Court, Mettur for restitution of conjugal rights has been withdrawn, nothing survives in the matter. Hence, placing on record the copy of the application memo filed before the Court below, the prayer in the transfer civil miscellaneous petition has become infructuous.
Accordingly, the Tr.C.M.P.No.385 of 2019 stands dismissed. Consequently, C.M.P.No.10658 of 2019 is also dismissed.
