Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to conduct enquire and take necessary action against the 7th respondent and consequently direct 6th Respondent to identify the eligible beneficiary in the Andiyappanur Village, Tirupattur Taluk, Tirupattur District under the Pradhan Mantri Awaas Yojana Gramin Scheme. ORDER
(Order of the Court was made by The Hon'ble Chief Justice) The grievance in this so called public interest litigation pertains to the alleged irregularities in the Pradhan Mantri Awaas Yojana Gramin Scheme.
2. The petitioner claims that the eligible persons may not have been included in the list of beneficiaries, while others may have been singled out for undeserving benefits.
3. Mr.P.Muthukumar, learned Government Pleader, takes notice on behalf of respondents 3 to 6. According to Mr.Muthukumar, the nodal officer for the project is the concerned Block Development Officer.
4. The matters complained of should not be taken up in this Court without the matter being attempted to be resolved at the local level. Accordingly, the petitioner is permitted to carry a detailed representation to the sixth respondent Block Development Officer for such official to deal with the representation in accordance with law, upon conducting an inquiry with notice to the petitioner and all others who may be affected thereby.
5. It is made clear that the merits of the petitioner's allegations against the seventh respondent have not been gone into. There is no doubt that the seventh respondent will be given previous notice by the concerned Block Development Officer before any steps are taken in the matter.
6. W.P.No.18047 of 2021 is disposed without any order as to costs.
