The applicant states that the 9th respondent filed a counter on 09.08.2021. From the said counter, it is stated that the applicant discovered that the Schedule - A property was mortgaged by the 9th respondent on 18.03.2009 under Document No.864 of 2009. Consequently, the applicant asserts that the first and fifth defendants have divested the 9th defendant of title through devious means. Consequently, it is stated that the amendments prayed for are necessary.

2. None of the defendants have filed a counter to this application and state that they do not propose to do so. The application has been filed at the pre-trial stage. On examining the affidavit in support of this application, it is evident that the amendments were necessitated by facts discovered by the application from the counter of the 9th respondent. Accordingly, A.No.1994 of 2022 is allowed as prayed for. As a consequence, the plaintiff is permitted to carry out the amendments specified in the schedule to the Judge's Summons on or before 28.06.2022.
