PRAYER:

Criminal Miscellaneous Petition filed under Section 482 of Criminal Procedure Code praying to relax the condition imposed by this Court by its order dated 20.02.2020 in Crl.M.P.No.2273 of 2020 i.e., "the petitioners shall report before the respondent police at 10.30 a.m., and 5.30 p.m., fortnightly on the first and fifteenth of every month" shall be relaxed by this Court.

O R D E R

(The case has been heard through video conference) This petition has been filed to relax the condition imposed by this Court by order dated 20.02.2020 in Crl.M.P.No.2273 of 2020 directing the petitioner to report before the respondent police at 10.30 a.m., and 5.30 p.m., fortnightly on the first and fifteenth of every month.

2. The learned Additional Public Prosecutor would submit that the petitioner was regularly complying with the condition from 21.01.2020 to 21.02.2020 and thereafter, he did not comply with the condition.

3. The learned counsel for the petitioner would submit that originally the petitioner was directed to appear before the respondent police daily at 10.30 a.m. Thereafter the petitioner filed a petition in Crl.M.P.No.2273 of 2020 and the condition was modified by order dated 20.02.2020 directing the petitioner to appear before the respondent police 1st and 15th of every month at 10.30 a.m. https://hcservices.ecourts.gov.in/hcservices/

Accordingly, the petitioner was complying with the conditions regularly and thereafter, due to Covid-19 and lockdown situation, the petitioner was unable to appear before the respondent and comply with the conditions.

4. At this juncture, the learned counsel for the intervenor would submit that the defacto complainant had filed a petition for cancellation of bail. But the same was dismissed by this Court. Against which, he had preferred a Special Leave Petition wherein, notice has been ordered to the respondent and that notice has been served on the petitioner/accused.

5. Taking into consideration, the above facts and circumstances, the condition imposed on the petitioner is modified to the effect that the petitioner shall appear before the respondent police on the first working day of every month at 10.30 a.m. after lifting of lockdown or the commencement of the Court's normal functioning whichever is earlier, until further orders.
