O R D E R
(This case has been heard through video conference) The petitioner who apprehend arrest at the hands of the respondent police for the offences publishable under Sections 363 of IPC @ into 363, 147, 342, 323, 386 and 506(i) IPC in Crime No.1132 of 2020, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that as per the defacto complainant, her husband who had gone to their agricultural land for irrigating the fields did not come back to home and lodged a complaint claiming that her husband had been kidnapped by somebody. Hence, the complaint.
3. The learned Counsel for the petitioner submitted that the petitioner has been falsely implicated in this case since he happens to be the relative of the main accused and since he questioned the arrest of the main accused, he was wrongly implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioners. https://hcservices.ecourts.gov.in/hcservices/
4. The learned Additional Public Prosecutor submitted that the petitioner and the other accused kidnapped the defacto complainant's husband and demanded money. He further submitted that the other accused are still in custody. Therefore, he opposed for grant of anticipatory bail to the petitioner.
5. Taking into consideration the fact that the other accused are still in custody, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly, the Criminal Original Petition is dismissed.
